In the last meeting of the Local Municipal Council this year, the one on December 27, the local elected officials approved the draft decision no. 712/2022 regarding the approval of the conclusion of the contract for assistance and legal representation services, according to Law no. 51/1995, in order to defend the interests of the Constanța Clinical Hospital for Infectious Diseases, by promoting and supporting an action based on Law no. 554/2004 of the administrative litigation in contradiction with the Ministry of Investments and European Projects, see the “documents” section.

“In order to provide a solid defense in relation to the complexity of the case and the value of the claim established against the Constanța Clinical Hospital for Infectious Diseases (1,292,004.42 lei, representing part of the equipment and medical equipment purchased from European funds and which were destroyed as a result of the fire from the date of 01.10.2022), an aspect that may involve risks regarding possible negative financial consequences on the Hospital’s budget, it is necessary that the formulation of the action in contradiction with the Ministry of Investments and European Projects be formulated by a specialized lawyer, familiar in the first place with the case in question, but also with professional experience, with special regard to the matter of European funds.

To the extent of the final unfavorable resolution of the file, the consequences may also fall on UAT Constanta, considering that the Iitigiul aims to contest the minutes of ascertainment and establishment of budget claims for the operational programs within the convergence objective no. 107287/20.09.2022 issued by the Ministry of Investments and European Funds, in which UAT is the beneficiary of the funding, a leader in the partnership with the Constanța Clinical Hospital for Infectious Diseases”, says the draft decision approved by the local councilors.

The request to hire a law firm with the approval of the Local Municipal Council came from the manager of the Constanța Clinical Hospital for Infectious Diseases, Dr. Claudia Cambrea.

He stated for ZIUA de Constanța that, since September of this year, the medical institution has been in correspondence with the Ministry of European Funds, but lately the two structures are discussing only through lawyers, respectively the hospital’s jurist.

Although the criminal investigation instrumented by the prosecutors of the Prosecutor’s Office attached to the Court of Constanța, after the fire of October 1, 2021, is far from a verdict, in the case investigations are still ongoing under the aspect of committing the crimes of manslaughter, culpable bodily harm and qualified destruction by fault, the Ministry of European Investments and Projects, led by the liberal Ioan Marcel Boloș, charges almost 1.3 million lei to the Hospital for Infectious Diseases, consisting of equipment purchased with European funds that burned during the fire (no five beds with ventilators and monitors).

In Constanța, the completion of the technical expertise aimed at establishing the possible causes and conditions in which the main fire occurred and the possible irregularities found in the documentation and preparation against fires is still awaited.

The expertise is carried out by the National Research – Development Institute for Mining Security and Anti-explosive Protection (INSEMEX) Petroșani together with the National Institute of Forensic Expertise (INEC) Iași.

However, the Ministry of Investments and European Projects believes that it would be the fault of the Hospital or its administrator (in this case Constanța City Hall, as credit orderer) and pre-announces it.

The manager of the Constanța Clinical Hospital for Infectious Diseases, Dr. Claudia Cambrea, told ZIUA de Constanţa that “hiring a law firm to contest this decision of the Ministry of Investments and European Projects is imperative, especially since all the addresses received from the ministry led to an imminent blocking of the hospital’s accounts”.

Cambrea also added that he found more understanding with the World Bank, which prefers to follow the procedure and recover the damage (no medical equipment), after the court will determine who is to blame for the fire in October 2021.

The situation is also known at the level of the Board of Directors of the Constanța Clinical Hospital for Infectious Diseases.

We remind you, after the fire, Dr. Stela Halichidis was dismissed from the position of hospital manager.

Later, it sued the Mayor of the Municipality of Constanța and requested the annulment of Provision no. 5199/04.10.2021.

14 months have passed since the fire that destroyed the Intensive Care Unit of the Hospital for Infectious Diseases in Constanța!
There were 113 people in the hospital, and there were ten patients in the Intensive Care Unit.

Seven people lost their lives as a result of the fire, and the other three people who were hospitalized in the Intensive Care Unit died in the following days.
