The European Union will have a “firm” reaction to the decision of the Polish Constitutional Court, which found incompatibilities with the EU Treaties, says Josep Borrell Fontelles, EU High Representative for Foreign Affairs and Security Policy.
„The answer will be firm. It must be clear: if you are a member of a club you must comply with the rules of the club. And the most important rule of the club is that the European legislation has supremacy over the national one. Otherwise, this club can no longer function as a Union. “, said Josep Borrell Fontelles, quoted by Reuters.
The European Commission has already suspended, due to disputes with Poland, the procedures for approving the Economic Recovery and Resilience Plan, so that the allocation of Community funds to Warsaw is blocked.
The Polish Constitutional Court ruled last week that some articles of European Union treaties are incompatible with Polish constitutional law, affecting the country’s sovereignty. “European bodies are acting beyond their powers,” said Julia Przylebska, president of Poland’s Constitutional Court. In fact, the Constitutional Court, the highest court in Poland, denounced “the interference of the Court of Justice of the European Union in the Polish judicial system”.
The decision highlights the primacy of Polish law over European treaties and is considered by analysts a real “legislative polexit”, amid recent disagreements between Brussels and the Warsaw Conservative government over the principles of the rule of law and the functioning of the Polish judiciary.
Amid criticism, Prime Minister Mateusz Morawiecki has announced that Poland has no plans to withdraw from the European Union.
